Voornemen tot heruitgifte recht van erfpacht ten behoeve van huidige erfpachter

De huidige erfpachter heeft per 1 januari 1950 het recht van erfpacht verkregen van de gemeente voor de duur van 75 jaar met betrekking tot de hiervoor gemelde percelen grond. Na verwerving van dit erfpachtrecht heeft erfpachter op deze percelen wooncomplexen gerealiseerd, en heeft deze percelen sindsdien in gebruik voor de verhuur van sociale huurwoningen als bedoeld in artikel 5.16c lid 1 sub a Besluit kwaliteit leefomgeving met een prijs onder de grens als bedoeld in artikel 13 lid 1 sub a van de Wet op Huurtoeslag.

De gemeente Zaanstad is eind 2023 met de huidige erfpachter overeengekomen dat het recht van erfpacht aansluitend aan de einddatum van het erfpachtrecht, met ingang van 1 januari 2025, opnieuw voortdurend is/wordt uitgegeven, reden waarom erfpachter de Percelen niet heeft ontruimd en de exploitatie daarvan ook na de einddatum heeft voortgezet. Deze heruitgifte wordt op korte termijn geformaliseerd en ingeschreven in de openbare registers.

Partij is de enige serieuze gegadigde

Gelet op het voorgaande is de gemeente van oordeel dat er op grond van objectieve, redelijke en toetsbare criteria slechts één serieuze gegadigde in aanmerking komt voor de heruitgifte in erfpacht van de voormelde percelen. Uitgifte aan derden is derhalve niet aan de orde.

Vervaltermijn

Tegen de voorgenomen vestiging van het zakelijk recht kunnen geen zienswijzen, bezwaren of beroep in de zin van de Algemene wet bestuursrecht worden ingediend c.q. ingesteld. Mocht u zich niet kunnen verenigen met de voorgenomen heruitgifte recht van erfpacht en merkt u zichzelf aan als een gekwalificeerde gegadigde dan kunt u binnen een termijn van 20 dagen na deze publicatie, uiterlijk 29 april 2025 vóór 12:00 uur, kenbaar te maken door middel van een gemotiveerd bericht te sturen naar erfpacht@zaanstad.nl, onder vermelding van: ‘Heruitgifte recht van erfpacht woningcorporaties’.

Bij gebreke van een tijdig en gemotiveerd bericht vervalt het recht tegen al het voornoemde in rechte op te komen en/of daarop enige vordering tot schadevergoeding of welke andere aanspraak dan ook te baseren, althans heeft u uw rechten daarop verwerkt. De gemeente Zaanstad en de eerder genoemde partij zouden immers onredelijk worden benadeeld, indien pas na deze (duidelijk kenbaar gemaakte) termijn alsnog tegen het voornemen respectievelijk het aangaan van de overeenkomst(en) zou worden opgekomen.

Met deze publicatie geeft de gemeente uitvoering aan het arrest van de Hoge Raad d.d. 26 november 2021 (ECLI:NL:HR:2021:1778).
